The Punjab and Haryana High Court, by an order dated 11.08.2026 in CWP-25086-2026 (Khajan Singh Yadav and Others v. State of Haryana and Others), stayed two orders passed by the Assistant Registrar, Cooperative Societies, Rewari. The first, dated 17.02.2026, was found prima facie to be without jurisdiction. The second, dated 20.03.2026, removed the Managing Committee of the society, and was found prima facie to be unwarranted and contrary to the Constitution as amended by the 97th Constitutional Amendment. The Court directed that the Managing Committee be put back in position pending the writ petition.
The Impugned Orders
The petitioners challenged two orders of the same officer. The first was dated 17.02.2026 (Annexure P-1). The second, dated 20.03.2026 (Annexure P-2), removed the Managing Committee of the society.
The Court’s Prima Facie View
After hearing counsel for the petitioners, the Court recorded that the order dated 17.02.2026 prima facie appeared to be without jurisdiction. The Court also referred to a collaboration agreement entered into with another builder, which it recorded as having consequently become null and void. As to the order dated 20.03.2026, the Court observed that the removal of the Managing Committee by the same officer was prima facie absolutely unwarranted and contrary to the mandate of the Constitution, as amended by the 97th Constitutional Amendment.
The Interim Direction
The State, having been served with an advance copy, appeared through the Additional Advocate General, Haryana, and sought time to file a written statement. The Court issued notice of motion, permitted the State to file its written statement three days before the next date, and listed the matter on 16.11.2026.
In the meantime, the Court stayed the operation of both impugned orders with immediate effect, and directed that the Managing Committee be put back in position to supervise and govern the functioning of the society. The observations are prima facie, made at the interim stage, and the writ petition remains pending.
